SnapWiFi Terms of Use

These Terms describe the rules for using SnapWiFi safely.

These Terms of Use (the “Terms”) set out the conditions under which SnapWiFi (the “App”) is provided and govern the rights and obligations between the operator and users. By using the App, you are deemed to have agreed to all provisions of these Terms.

Note: These Terms are governed by Japanese law and were originally drafted in Japanese. The English version is provided for convenience only; in case of any discrepancy, the Japanese version prevails.

Article 1 (Application)

These Terms apply to all matters relating to the use of the App. If the content of these Terms differs from any explanation given in in-app help or notices, these Terms prevail.

Article 2 (Definitions)

The terms used in these Terms have the following meanings:

Article 3 (Conditions of Use)

  1. The User shall use the App at their own responsibility and judgement.
  2. The User shall use the App only with respect to Wi-Fi information that they are authorised to read.
  3. The User shall comply with applicable laws and public order and morals when using the App.

Article 4 (Prohibited Acts)

The User must not engage in any of the following acts, or any act that may lead to such an act, when using the App:

  1. Acts that violate laws or public order and morals.
  2. Acts related to criminal activity.
  3. Acts intended to gain unauthorised access to Wi-Fi networks the User is not authorised to use.
  4. Acts that infringe the rights of third parties (intellectual property rights, portrait rights, privacy rights, rights of honour, or other rights).
  5. Acts that destroy or interfere with the function of the App's servers or networks.
  6. Reverse engineering, decompilation, disassembly, or any other analysis of the App, except to the extent permitted by law.
  7. Use of the App for any improper purpose.
  8. Acts that may interfere with the operation of the App.
  9. Any other act that the operator considers inappropriate.

Article 5 (Handling of Content)

  1. Copyright and other rights in Content that the User inputs or transmits to the App belong to the User or the relevant rightsholder, and the operator does not acquire such rights.
  2. The User grants the operator a licence to use the Content only to the extent necessary to achieve the purpose of the App, including extracting Wi-Fi information from images and temporary transmission to third-party service providers.
  3. Details of the handling of Content are governed by the separately defined Privacy Policy.

Article 6 (Provision, Modification, and Suspension of the App)

  1. The operator may modify the content of the App or suspend its provision to the extent the operator deems necessary.
  2. The operator may suspend or interrupt provision of all or part of the App without prior notice to Users in any of the following cases:
    1. Maintenance, inspection, or update of the systems related to the App.
    2. Where provision of the App becomes difficult due to force majeure, including earthquake, lightning, fire, power outage, natural disaster, or pandemic.
    3. Where computers or communication lines have stopped due to an accident.
    4. Where provision of the App becomes difficult due to suspension, modification, or termination of third-party services (such as image-analysis APIs).
    5. Any other case in which the operator determines that provision of the App is difficult.

Article 7 (Disclaimer)

  1. The operator makes no warranties, express or implied, regarding the accuracy, completeness, usefulness, fitness for a particular purpose, success of Wi-Fi connection, or any other matter relating to the Wi-Fi information read by the App.
  2. To the extent permitted by applicable law, the operator is not liable for any damages incurred by the User in connection with the use of the App, including damages relating to the User's communication environment, device settings, or third-party services.
  3. Even where the operator bears liability for damages, except in cases of wilful misconduct or gross negligence on the part of the operator, such liability shall be limited to ordinary damages and shall not extend to indirect, special, consequential damages, or lost profits.

Article 8 (Restriction of Use)

If the operator determines that the User has violated any provision of these Terms, the operator may restrict the User's use of the App without prior notice. The operator is not liable for any damages incurred by the User or any third party as a result.

Article 9 (Changes to These Terms)

  1. The operator may, where it deems necessary, change these Terms after notifying Users. Important changes will be announced in the App, on the official site, or by other appropriate means.
  2. The amended Terms shall take effect on the effective date specified by the operator.

Article 10 (Severability)

Even if any provision or part of these Terms is determined to be invalid or unenforceable under applicable law, the remaining provisions and the portions of the affected provision that are not invalid or unenforceable shall continue in full force and effect.

Article 11 (Governing Law and Jurisdiction)

  1. These Terms and the use of the App shall be governed by the laws of Japan.
  2. Any dispute arising between the operator and a User in connection with the App shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.

Article 12 (Operator and Contact)

The operator's address is not published in these Terms; however, the operator will respond in accordance with the prescribed procedures upon a disclosure request based on applicable law.
